Terms and Conditions

These Terms and Conditions govern access to and use of totaltrade.ai, app.totaltrade.ai and the related services offered under the TotalTrade name (collectively, the “Service”). Please read them carefully before creating an account, purchasing a plan or using the Service.

The Service is provided by Daniel Totò, VAT No. 02453620516, Italian Tax Code TTODNL00D20F592R, REA AR - 216044, with registered office at Località Comune 109, 52046 Lucignano (AR), Italy; support@totaltrade.ai; certified email blastrade@pec.it (the “Provider”). By using the Service, you confirm that you have read, understood and accepted these Terms.

1. Description of the Service

TotalTrade is an informational, educational and analytical platform for traders. Depending on the selected plan and current availability, it may include Backtester, Journal, DeepView, market and account analytics, Community, educational content, session sharing, Feedback Hub, integrations and features expressly identified as experimental or beta.

  • The Service does not provide investment advice, portfolio management, brokerage, execution or personalised financial recommendations.
  • Any simulation, statistic, score, insight or educational material is provided solely as a decision-support resource and does not guarantee any result.
  • Features, limits and availability may differ by plan, device, country, third-party provider or development stage.

2. Eligibility and permitted use

You may use the Service only if you are at least 18, have the legal capacity to enter into a binding agreement and comply with all laws and regulations applicable to you.

  • You must use the Service for lawful personal or professional purposes and in accordance with these Terms.
  • You remain responsible for determining whether trading, imported data and any connected account are permitted in your jurisdiction and under the rules of your broker, prop firm or other provider.
  • You may not use TotalTrade to provide unauthorised financial advice, manage third-party funds or misrepresent yourself as acting on behalf of TotalTrade.

3. User account and security

You must provide accurate, current and complete information, keep it updated and protect your credentials, devices and active sessions. You are responsible for activity performed through your account unless you promptly report unauthorised access that is not attributable to your conduct.

  • Do not share, sell, transfer or rent your account or credentials.
  • Do not create multiple accounts to bypass plan limits, restrictions, suspensions or promotional conditions.
  • Notify support@totaltrade.ai without delay if you suspect unauthorised access, credential compromise or misuse.

4. Plans, subscriptions, prices and renewal

Paid plans may be offered monthly, annually or for another period displayed at checkout. The applicable price, billing frequency, included features and renewal terms are those shown before purchase. Payments and subscription management may be processed by Stripe or another disclosed payment provider.

Unless clearly stated otherwise, subscriptions renew automatically for the same billing period until cancelled. You must cancel before the next charge through the available account portal or payment provider. Cancellation stops future renewal but does not normally terminate access already paid for.

Where Article 65-bis of the Italian Consumer Code applies to a fixed-term service contract with automatic renewal, consumers are entitled to the required written or durable-medium reminder at least 30 days before expiry and to the statutory consequences if it is not sent. This clause does not state that a technical reminder is active unless it has actually been implemented.

  • Taxes, currency conversion and bank charges may apply depending on your location and payment method.
  • Prices and plan contents may change prospectively. Material changes affecting an active subscription will be communicated where required.
  • Before confirming a purchase, verify the total price, billing period, renewal date, cancellation method and included features.

5. Right of withdrawal and refunds

Consumers normally have a 14-day statutory withdrawal right. For a service started on an express request, only a proportionate amount may be due if the consumer withdraws before completion; loss after full performance requires the statutory express consent and acknowledgement. For digital content supplied immediately, loss requires prior express consent, acknowledgement and confirmation on a durable medium. If checkout does not collect the required evidence, these Terms alone do not remove the right.

Refunds are governed by the Refund Policy, which forms part of these Terms. There is no automatic refund for a billing period that has started, non-use or partial use, failure to cancel renewal, or purchasing errors attributable to the user. Nothing in these Terms limits mandatory consumer rights.

6. Limited licence

Subject to these Terms and payment of any applicable fee, the Provider grants you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Service for its intended purposes.

  • You may not copy, reproduce, distribute, resell, sublicense or commercially exploit the Service or its content without written permission.
  • Except where mandatory law expressly permits it, you may not reverse engineer, decompile or disassemble the Service, or attempt to reconstruct source code, internal logic, non-public interfaces or database structures.
  • You may not use unauthorised bots, crawlers, spiders, headless browsers, scripts or other automated systems to access the Service, query services or APIs, monitor or copy content, scrape pages or systematically extract data or outputs.
  • You may not use Service data, content, outputs or materials to assemble datasets, train or evaluate artificial-intelligence models, conduct unauthorised benchmarking, or develop competing, substitute or derivative products or services.
  • You may not bypass authentication, access controls, usage or rate limits, anti-bot measures, technical protections or other functional or contractual restrictions, or interfere with security, availability, performance or another user's lawful access.

7. Intellectual property and feedback

The Service, software, interfaces, databases, designs, trademarks, text, graphics, videos and original materials are owned by the Provider or their respective licensors and are protected by applicable intellectual-property laws. No rights are transferred except for the limited licence expressly granted above.

If you voluntarily provide suggestions or feedback, the Provider may use them to improve the Service without restriction or compensation, provided that your personal data is handled in accordance with the Privacy Policy.

8. External sources and service dependencies

The Service may display, process or depend on information and infrastructure supplied by third parties, including Dukascopy, Myfxbook, CFTC, TradingView, payment processors, cloud and hosting providers, content-delivery networks, security and authentication services. Third-party availability, accuracy and policies are outside the Provider’s direct control.

  • Market, broker and external-source data may be delayed, incomplete, inaccurate or unavailable.
  • References or links to third parties do not constitute endorsement, partnership or a guarantee of their solvency, conduct or services.
  • You are responsible for reviewing the terms and privacy notices of any third-party service you choose to use.

9. Trading-account connections and imports

TotalTrade may allow you to connect or import information from MT5, cTrader, CSV files or other supported sources. You authorise only the access technically required for the selected function and remain responsible for the legitimacy, accuracy and security of the data and credentials you supply.

  • Confirm that the connection or export is permitted by your broker, prop firm and applicable rules.
  • Do not upload data, credentials or files that you are not authorised to use.
  • The Provider is not responsible for restrictions imposed by brokers or prop firms, misuse of credentials attributable to the user, or errors originating in third-party systems or user-supplied files.

10. Broker directory and external information

Any list, comparison or reference to brokers, prop firms, instruments or external services is informational only. TotalTrade does not guarantee licensing status, suitability, availability, commercial conditions, solvency or future conduct. Verify every provider independently before opening an account, depositing funds or acting on any information.

11. Community, educational content and sharing

Interactive and educational areas are designed for learning and collaboration. Users, speakers and contributors act independently unless expressly identified as authorised representatives of TotalTrade.

  • Communicate respectfully and do not publish unlawful, defamatory, deceptive, threatening, discriminatory or rights-infringing content.
  • Do not share confidential or copyrighted material without permission, redistribute restricted educational content, spam users or promote unauthorised financial services.
  • Educational content and community discussion do not constitute personalised financial advice and must be assessed independently.

12. Simulated nature of backtesting

Backtests reconstruct hypothetical scenarios using historical data; they are not actual executions and do not guarantee future results. They may not fully reflect spreads, commissions, slippage, liquidity, latency, gaps, rejected orders, data quality or the emotional effects of live trading. Hindsight and overfitting may reduce a model's reliability.

  • You are responsible for interpreting results and making your own decisions.
  • TotalTrade does not promise profitability or that a strategy is suitable for live trading.
  • Mandatory consumer rights remain unaffected.

13. Beta and experimental features

Features identified as beta, preview, experimental or similar may be incomplete, change without notice, contain errors or be discontinued. They are provided for evaluation and should not be used as the sole basis for critical, financial or irreversible decisions.

14. User-generated content

You retain ownership of content you lawfully submit. You grant the Provider a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt and display that content only as reasonably necessary to operate, secure and improve the Service and provide the sharing functions you select.

  • You represent that you have all rights and permissions required for your content.
  • The Provider may remove, restrict or preserve content where reasonably necessary to enforce these Terms, protect users, comply with law or respond to valid claims.
  • You remain responsible for backups of content that is important to you.

15. Service boundaries and limitation of liability

TotalTrade does not provide access to financial markets, execute transactions or accept funds for trading. Using the Service does not, by itself, expose you to market losses. If you independently choose to trade through a broker, proprietary trading firm or another third party, the resulting decisions and financial risks remain outside the Service and under your responsibility. Past performance, simulated results and backtests do not guarantee future outcomes.

To the fullest extent permitted by law, the Provider is not liable for indirect or consequential loss, loss of profit, opportunity, data or capital, trading decisions, strategy performance, errors or interruptions caused by third-party data, providers, APIs, integrations or payment services, or use contrary to these Terms.

Nothing excludes liability that cannot lawfully be excluded, including mandatory consumer protections and liability for fraud, wilful misconduct or other cases established by applicable law.

16. Force majeure

The Provider is not responsible for delay or failure caused by events beyond reasonable control, including network or power outages, cyberattacks, provider failures, strikes, epidemics or pandemics, war, public-authority measures, natural disasters or the unavailability of essential third-party services. Reasonable efforts will be made to restore the Service.

17. Suspension and termination

Access may be limited, suspended or terminated where reasonably necessary for maintenance, security, legal or regulatory compliance, non-payment, abusive disputes, suspected unlawful conduct, misuse, risk to the platform or other users, or material breach of these Terms. Where appropriate and legally required, notice and an opportunity to remedy will be provided.

  • You may stop using the Service and cancel your subscription at any time, subject to the applicable billing terms.
  • Upon termination, the licence granted under these Terms ends. Provisions intended by their nature to survive will remain effective.
  • Data deletion and retention are governed by the Privacy Policy and applicable law.

18. Privacy and cookies

Personal data is processed as described in the Privacy Policy. Cookies and similar technologies are governed by the Cookie Policy and, where required, your consent choices. These documents form an integral part of the rules governing use of the Service.

19. Changes to the Service or these Terms

The Provider may update the Service or these Terms because of changes in law or regulation, security and abuse-prevention requirements, necessary technical adjustments, developments to Service functions or other objective and documented operational needs. Changes do not affect rights already accrued. Material changes affecting an active subscription will be notified with reasonable advance notice by email, through the account area or on another durable medium, stating their effective date and contractual consequences. If a change materially and adversely affects the paid Service, a consumer may terminate without charge before it takes effect, unless the change is required by law or addresses a security risk that cannot be deferred. Continued use after the effective date constitutes acceptance only where legally valid and does not replace express consent when required.

20. Governing law and jurisdiction

These Terms are governed by Italian law. For users acting as consumers, mandatory protections and the competent courts established by the law of their country of residence remain unaffected. For users who are not consumers, the Court of Arezzo has exclusive jurisdiction, unless mandatory law provides otherwise.

21. Final provisions and contact

If any provision is held invalid or unenforceable, the remaining provisions remain effective. Failure to enforce a right does not constitute a waiver. These Terms, together with the incorporated policies and the purchase information displayed at checkout, constitute the agreement governing use of the Service.
